Refund & Cancellation Policy
Effective: April 24, 2026
This policy describes when ImFiled will issue refunds and how you can cancel your order. ImFiled is a document preparation service. Our service fee covers the preparation of your USCIS Form I-130 filing package, including licensed-attorney completeness review.
Cancellation before work begins
If you cancel your order before we begin preparing your document package — that is, before you have completed the intake questionnaire and submitted it for processing — you are entitled to a full refund of the service fee. To cancel, contact us through the contact information listed on our site with your order information.
Cancellation after work begins
Once you have submitted your intake questionnaire and we have begun preparing your document package, the service fee is non-refundable except as described in the section below.
Refund for preparation errors
If USCIS rejects your I-130 filing due to an administrative error in document preparation that we caused, we will refund your service fee in full. To request this refund, you must:
- Contact us through the contact information listed on our site within 60 days of the USCIS rejection notice
- Provide a copy of the USCIS rejection notice identifying the error
We will review your request and respond within 10 business days. If we confirm the rejection was caused by our preparation error, we will process the refund to your original payment method within 5 to 10 business days.
What is not covered
The following situations are not eligible for a refund:
- Denials based on legal or eligibility grounds
- Rejections caused by inaccurate, incomplete, or misleading information you provided during intake
- Rejections caused by supporting documents you failed to provide or that were unacceptable to USCIS
- Changes in USCIS policy, regulations, or law that occur after your package was delivered
- Delays in USCIS processing or adjudication timelines
- Cases where you chose not to file the package we prepared
Government filing fees
Government filing fees paid directly to USCIS are collected by USCIS, not by ImFiled, and are never refundable by us. Refer to USCIS directly for their fee refund policy.
Rush order fees
The rush processing surcharge is non-refundable once rush processing has begun, regardless of the outcome. Rush processing is considered begun once your package enters attorney review under rush priority.
How to request a refund
Contact us through the contact information listed on our site with the subject “Refund Request” and include your name, order confirmation number, and the reason for your request. We will confirm receipt within 2 business days.
Changes to this policy
We may update this policy from time to time. The effective date at the top of this page reflects the most recent revision. The policy in effect at the time of your purchase governs your order.
